SMART COLORS™ by Tetrachrom

This Privacy Policy describes how Tetrachrom, Inc. (“Tetrachrom,” “we,” “us,” or “our”) collects, uses, and protects information in connection with the SMART COLORS™ application and related services (collectively, the “Services”).

SMART COLORS™ is a Shopify-only B2B application designed for merchants and does not collect personal data directly from shoppers.

1. Information Collected Through Shopify APIs

SMART COLORS™ accesses only the minimum Shopify store data required to provide requested functionality and processes that data in accordance with Shopify API Terms, Shopify Partner Program requirements, Shopify policies, this Privacy Policy, and applicable law. We do not access or process unrelated store data.

Examples of data accessed include:

  • Product titles
  • Product images
  • Color attributes and tags
  • Metadata and webhook events
  • Store configuration settings
  • Aggregated, non-identifiable interaction data related to SMART COLORS™ features

The App may request Shopify API permissions including read_products, write_products (if applicable), read_themes, and related permissions necessary for color search and merchandising functionality.
We do not access Shopify payment information, customer passwords, or financial data, and we access only the minimum Shopify store data required to provide requested functionality.

2. Information Collected Directly from Merchants

We collect basic merchant account information when merchants install the app or communicate with us, such as:

  • Store name
  • Store URL / myshopify domain
  • Store ID
  • Merchant email (store contact email)
  • Shop owner name (sometimes)
  • Locale, currency, and time zone

We also generate automated system logs related to the merchant’s use of SMART COLORS™, such as feature usage, performance metrics, and error reports, to operate and improve the Services.

We do not request or collect personal information about merchants’ customers directly from the merchant.

SMART COLORS™ does not access or collect customer payment information, merchant credit card information, personal passwords, or other sensitive financial or authentication credentials.

3. Information Collected from Merchants’ Customers

SMART COLORS™ does not collect personal information directly from merchants’ customers.

We may receive anonymized or aggregated usage data related to interaction events with color search features (for example: filter usage, clicks, product interactions, add-to-cart events, and purchase or conversion signals), subject to Shopify customer privacy settings and permissions, but this information is not used to identify individuals.

SMART COLORS™ does not place tracking cookies on merchant customers’ devices unless required for basic functionality, and we do not engage in cross-context behavioral advertising based on shopper data.

4. How We Use Information

We use collected information solely to operate, maintain, secure, and improve SMART COLORS™, including delivering color search results, analytics insights, and product discovery features for merchants. We may also use aggregated and anonymized data to improve system performance, develop new features, and generate internal analytics.

We do not sell merchant data or any personal data contained within merchant store data and do not use it for unrelated marketing or advertising purposes.

5. Data Retention

We retain merchant data only as long as necessary to provide the Services, comply with legal obligations, and maintain operational records. If a merchant uninstalls SMART COLORS™, Shopify sends an uninstall webhook, after which we delete or anonymize merchant store data within 30 days unless retention is legally required.

Merchants may request deletion of their data at any time by contacting privacy@tetrachrom.ai, and Tetrachrom will respond within legally required timeframes.

6. International Data Transfers

Tetrachrom, Inc. is currently based in the United States and may expand operations internationally in the future. Merchant data may be processed or stored in the United States or other jurisdictions where our infrastructure providers operate, in accordance with applicable data-protection laws and appropriate safeguards.

If you are located in the European Economic Area or the United Kingdom, you also have the right to lodge a complaint with your local data-protection authority. To exercise any of these rights, please contact us using the information provided below.

7. Merchant Data Use

SMART COLORS™ accesses and processes merchant data such as product catalogs, images, color metadata, and store configuration information solely to provide and improve the Services.

We access only the minimum Shopify store data required and process it in accordance with Shopify API Terms, Shopify Partner Program requirements, our Privacy Policy, and applicable law.

We do not sell merchant data and use it only as necessary to operate search, analytics, and related features requested by the merchant.

Merchants remain the data controllers of their store data, and Tetrachrom acts as a data processor on their behalf.

8. Subprocessor Disclosure

We may engage trusted third-party service providers (such as cloud infrastructure, analytics, and communication providers) to support the operation of the Services. These subprocessors are contractually obligated to maintain appropriate confidentiality, security, and data-protection standards.

9. Artificial Intelligence and Machine Learning

SMART COLORS™ uses artificial intelligence and machine learning to analyze product images and generate color metadata used for search and merchandising functionality. Product images are processed through a transient pipeline to produce color attributes and are not stored or used to train generalized AI or machine-learning models outside the scope of providing the Services. Any system improvements are based only on aggregated and anonymized data where applicable.

If future features require additional data use or model training, SMART COLORS™ will do so only with appropriate notice to merchants and in accordance with our Privacy Policy, Shopify’s Partner Program requirements, and applicable law.

10. Advertising and Marketing Use

SMART COLORS™ does not use merchant data or any personal data contained within merchant store data to create interest-based advertising segments or to target ads. We may use aggregated, anonymized usage data related to SMART COLORS™ features to understand product performance and improve the Services, but this information is not used to identify individuals or deliver targeted advertising.

If future marketing analytics features require limited use of personal data, we will use aggregated or anonymized data where possible and handle any personal data in accordance with this Privacy Policy, Shopify’s Partner Program requirements, and applicable law.

11. When We Share Information

We do not sell merchant data or any personal data.

We may share information:

  • With service providers who help us run the Services, under confidentiality obligations
  • When required by law or to protect the integrity of the Services
  • In connection with a merger, restructuring, or transfer of assets
  • When you explicitly choose to share information or give consent

12. Your Rights and Choices

Depending on your location, merchants may request access to their data, corrections or updates, deletion of their data, or restriction of certain processing.

If you are in the EEA or UK, you also have the right to lodge a complaint with your local data-protection authority.

13. Legal Grounds (EEA / UK)

Where applicable, we process merchant data based on consent, performance of a contract, legal obligations, or legitimate interests balanced against your rights.

14. How We Protect Information

SMART COLORS™ is hosted on secure AWS cloud infrastructure in the United States, with encrypted connections and access-controlled environments. We use reasonable technical, organizational, and administrative safeguards to protect personal data. While no system is perfectly secure, we are intentional about minimizing risk and respecting trust.

15. Changes to This Policy

As SMART COLORS™ evolves, this Privacy Policy may change. Updates will be posted here with a revised “Last Updated” date.
